5th Circ. Won't Reinstate Dallas Morning News ADEA Suit

Law360, New York (August 21, 2012, 2:34 PM EDT) -- The Fifth Circuit refused Monday to revive an Age Discrimination in Employment Act case brought against The Dallas Morning News Inc., affirming a ruling that said undue subjectivity during a reduction in force wasn't a proper basis for an ADEA disparate impact claim.
