6th Circ. Tosses Nurse's Lunch Pay Suit As Time-Barred

Law360, New York (August 21, 2012, 4:41 PM EDT) -- The Sixth Circuit upheld a decision Tuesday to toss a former nurse’s collective action against Baptist Memorial Hospital Inc. over lunch break pay deductions, finding he had failed to file a required consent form before the statute of limitations expired.

In a unanimous decision, the appeals court found that a Tennessee federal judge correctly had ruled that James Allen Frye had failed to comply with the Fair Labor Standards Act provision that required plaintiffs to file written consent to opt in to a collective action....
