Chipotle Worker Loses 2nd Class Bid In Meal Break Case

Law360, New York (August 22, 2012, 3:39 PM EDT) -- A California appeals court upheld the denial of class certification in a meal break case against Chipotle Mexican Grill Inc. for the second time on Tuesday, ruling that the California Supreme Court's Brinker decision shouldn't change the outcome of an ex-employee's appeal.

Plaintiff-appellant Rogelio Hernandez saw the state appeals court affirm the decision to deny class certification in October 2010, when it ruled that while employers have to provide the meal breaks required under California law, they don't have to make sure employees take them....
