PTO Invalidates Novartis Unit's HIV Diagnostic Patent

Law360, New York (October 11, 2007, 12:00 AM EDT) -- In a blow to a Novartis AG subsidiary, the U.S. Patent and Trademark Office has issued a final interference decision striking down a patent covering technology for detecting HIV in the blood.

The decision, handed down Sept. 28 but made public Wednesday, the PTO’s Board of Patent Appeals and Interferences ordered that judgment on priority would be entered against inventors Paul A. Luciw and Dino Dina of Novartis Vaccines and Diagnostics Inc.

The inventors are not entitled to a patent containing claims 1-45 of the patent...
