Judge Won't Toss Manager's Claims In Enterprise OT Case

Law360, Philadelphia (August 23, 2012, 6:43 PM EDT) -- A federal court judge on Wednesday refused to grant summary judgment to an Enterprise Rent-A-Car subsidiary seeking to dismiss a sample plaintiff’s wage-and-hour claims as part of ongoing multidistrict litigation brought by assistant managers with the company.

U.S. District Court Judge Joy Conti ruled that Enterprise had not sufficiently proven that Joseph Biski, an assistant manager with Enterprise in upstate New York, was exempt from receiving overtime compensation under the Federal Labor Standards Act based on his day-to-day job responsibilities.
