Mensing Bars Generic Reglan Suits, Drug Cos. Tell Pa. Court

Law360, Philadelphia (November 28, 2012, 4:29 PM ET) -- A group of drugmakers including Teva Pharmaceuticals USA told the Pennsylvania Superior Court during oral arguments Wednesday that thousands of claims of neurological damage stemming from use of generic versions of the digestion drug Reglan should be tossed from state court because they are federally preempted.

The pharmaceutical companies, appealing a 2011 order by a Philadelphia County judge refusing to dismiss more than 2,000 Reglan-related product liability cases pending as part of a mass tort program there, argued that the suits were allowed to move forward...
