Appeals Court Rejects Franklin Mint, Princess Diana Settlement

Law360, New York (July 19, 2005, 12:00 AM ET) -- A California appeals court has rejected Franklin Mint Corp.'s $25-million settlement with the Diana Princess of Wales Memorial Fund to end a malicious-prosecution case against the fund and law firm Manatt, Phelps & Phillips as part of a long-running trademark dispute.

The Second District Court Of Appeal in Los Angeles said the lower court's determination that the settlement was in good faith could not be upheld because the “parties failed to set a value for the settlement, and failed to present competent evidence proving a value.”...
