CFTC Floats CEA Exemptions For Utility Deals

Law360, New York (August 27, 2012, 5:43 PM EDT) -- The U.S. Commodity Futures Trading Commission is proposing to exempt certain transactions by regional transmission organizations and independent system operators from some Commodity Exchange Act provisions, according to a Federal Register notice scheduled to be published Tuesday.

The commission issued a proposed order of the exemption in response to a February petition by ISOs, including California Independent System Operator Corp., and RTOs, including Midwest Independent Transmission System Operator Inc., that argued certain transactions authorized under tariffs by the Federal Energy Regulatory Commission or the Public Utility...
