Asbestos Whistleblower’s Retaliation Win Upheld In Texas

Law360, Dallas (August 29, 2012, 4:57 PM EDT) -- A Texas appeals court on Wednesday said that the city of San Antonio’s water system had fired an employee for reporting that the utility was illegally dumping pipes that contained asbestos, but said the worker wasn’t entitled to damages for mental anguish.

Mostly affirming a trial court judgment, the panel ruled San Antonio Water System, or SAWS, fired Kevin Martin because he reported the utility’s practice of disposing of asbestos-containing pipe near a creek, though Martin had been promised protection under the Texas Whistleblower Act. It...
