Toys 'R' Us Fails To Win Coverage In Worker Injury Row

Law360, New York (September 5, 2012, 4:30 PM EDT) -- Ruling on an additional insured dispute, a New Jersey appeals court on Wednesday agreed a temporary employment agency and Hartford Fire Insurance Co. have no responsibility to cover Toys "R" Us-Delaware Inc. over an injured worker's negligence suit.

A three-judge panel with the state's Appellate Division backed a trial court's findings that WillStaff Crystal Inc. and Hartford never agreed to defend or indemnify TRU for its own alleged negligence and that TRU was responsible for making sure its own equipment was safe to use.
