Pa. Supreme Court Will Address Attorney-Expert Privilege

Law360, Philadelphia (September 6, 2012, 7:29 PM EDT) -- The Pennsylvania Supreme Court has announced it will weigh in on a debate over whether communications between an attorney and expert trial witnesses are subject to total confidentiality under state law.

On Aug. 31, the justices said they would reconsider a 2011 decision by the Pennsylvania Superior Court which ruled that a Cumberland County orthopedic center ensnared in a personal injury suit did not have to turn over correspondence between the plaintiff’s attorney and a doctor tagged to testify as an expert witness in the case...
