11th Circ. Lets ID Theft Victims Sue Health Insurer

Law360, New York (September 7, 2012, 4:35 PM EDT) -- The Eleventh Circuit on Wednesday revived a proposed class action accusing health insurer AvMed Inc. of poor data privacy safeguards, saying the lawsuit should proceed because it claims the information used to commit identity theft was the same information that was stolen.

In reaching its conclusion, the appeals court suggested it would not have been enough for AvMed customers Juana Curry and William Moore simply to show they had financial data compromised following the theft of company laptop computers with patients’ personal information. But their case...
