EU Threatens Malta With ECJ Action

Law360, New York (October 18, 2007, 12:00 AM EDT) -- The European Commission has thrown down the gauntlet in its spat with Malta over its petroleum monopoly, threatening to refer the member state to the European Court of Justice if it does not take pro-competitive steps within three months.

The commission said Thursday that it would take the matter to Europe's highest court unless Malta begins to adjust the government stranglehold on the importation, storage and wholesale of petroleum products.
