2nd Circ. Finds Queens Prosecutors Immune In Civil Rights Row

Law360, New York (September 14, 2012, 10:01 PM EDT) -- The Second Circuit on Friday ruled that two Queens prosecutors accused of civil rights violations for interrogating former New York state Sen. Hiram Monserrate’s girlfriend over suspected domestic abuse by the lawmaker are protected by absolute immunity.

The three-judge panel found that Queens County assistant district attorneys Scott Evan Kessler and Keshia Espinal were carrying out an interview that was an integral part of their advocatory function as prosecutors, vacating and remanding a lower court ruling that they were not immune from Karla Giraldo's civil rights...
