11th Circ. Buries Record Label's Nelly Furtado IP Suit

Law360, New York (September 14, 2012, 10:10 PM EDT) -- The Eleventh Circuit refused Friday to revive a Finnish record label's lawsuit that claimed one of its recordings was illegally copied in a Nelly Furtado song, although it faulted a lower court's assumption that Internet publication means simultaneous, worldwide distribution of a work.

A three-judge panel upheld the dismissal of Kernel Records Oy's case against Furtado, music producer Timbaland, UMG Recordings Inc. and others, despite saying that the trial court should not have granted Timbaland's motion for summary judgment.
