IP Group Weighs In On Fed. Circ.'s Interlocutory Reach

Law360, New York (September 26, 2012, 6:05 PM EDT) -- The Intellectual Property Owners Association told the Federal Circuit in an amicus brief Monday that the court does not have jurisdiction over interlocutory patent appeals when a lower court has not yet ruled on willfulness, but can hear such appeals if damages have not yet been determined.

The Federal Circuit is holding an en banc review of a patent case between rival windshield wiper manufacturers Robert Bosch LLC and Pylon Manufacturing Corp. in order to consider its statutory authority to hear interlocutory appeals in patent cases....
