Pom Customers Score Class Cert. In False Advertising Case

Law360, New York (October 1, 2012, 4:07 PM EDT) -- A California federal judge on Sunday certified a nationwide class of consumers who claim Pom Wonderful LLC's ads touting its pomegranate juice's health benefits were misleading.

Pom had argued that the plaintiffs couldn't certify a nationwide class under California's consumer laws because there are significant differences between individual states' consumer protection laws, and cited the Ninth Circuit's July decision in Mazza v. American Honda Motor Co. in which the court ruled a class of car buyers hadn't met key commonality and choice-of-law requirements.
