Roche's Boniva Patent Declared Invalid

Law360, New York (October 1, 2012, 6:48 PM EDT) -- A New Jersey federal judge on Monday invalidated the remaining patent in Hoffmann-La Roche Inc.'s consolidated lawsuits against Apotex Inc., Mylan Inc. and other generic drugmakers over the osteoporosis drug Boniva, issuing an unprompted ruling that the bone treatment is obvious.

U.S. District Judge Stanley R. Chesler handed down a sua sponte decision that Roche's U.S. Patent Number 7,410,957 was nearly identical to its U.S. Patent Number 7,718,634 — which Judge Chesler declared invalid due to obviousness in May.
