Dow Awarded $5.3M In Costs From Bayer In Corn Patent Fight

Law360, New York (October 1, 2012, 10:10 PM EDT) -- A North Carolina federal judge on Friday awarded two Dow AgroSciences LLC affiliates $5.3 million in a dispute over Bayer Bioscience NV's patents for insect-resistant corn products that were found to be unenforceable.

U.S. District Judge William L. Osteen Jr. awarded Dow units Mycogen Plant Science Inc. and Agrigenetics Inc. their requested attorneys' fees and costs after rulings in various related lawsuits deemed U.S. Patent Numbers 5,254,799 and 5,545,565 unenforceable because of inequitable conduct on the part of Bayer's unit Plant Genetic Systems NV.
