Music Co. Wants 7th Circ. To Revive Lionsgate '50/50' Suit

Law360, New York (October 3, 2012, 6:16 PM EDT) -- Eastland Music Group LLC on Monday asked the Seventh Circuit to reinstitute its suit against Lionsgate Entertainment Inc., claiming a lower court rushed in dismissing its claims that Lionsgate's “50/50” film infringed a company trademark.

Eastland contends that an Illinois federal court improperly denied its right to defend its “PHIFTY-50” trademark against Lionsgate by dismissing the case solely based on Lionsgate's rebuttals to Eastland's complaint, making the decision before either party had the opportunity to submit evidence.
