After Brinker, Ex-Tenet Workers Lose Class Cert. Bid Again

Law360, New York (October 4, 2012, 4:57 PM EDT) -- On reconsideration of its earlier denial in light of the state Supreme Court’s decision in Brinker Restaurant Corp., a California state appeals court on Thursday again denied class certification to a group of former Tenet Healthcare Corp. employees who claimed the company failed to pay them wages for missed meal periods and rest breaks.
