OMB Advises Fed. Agencies On Energy Savings Contracts

Law360, New York (October 5, 2012, 7:11 PM EDT) -- The U.S. Office of Management and Budget on Wednesday issued guidelines for federal agencies regarding their entry into energy savings performance contracts and utility energy service contracts for energy efficiency and new renewable power generation.

In bringing such guidance, the OMB said it was setting the conditions under which the budget costs of ESPCs and UESCs — including their total capital costs — may be scored on a yearly basis during the term of the contract as opposed to having these costs fully scored up front...
