High Court Nixes Appeal Over KBR Civilian Driver Deaths

Law360, New York (October 9, 2012, 2:08 PM EDT) -- The U.S. Supreme Court on Tuesday declined to review a decision that blocked a suit asserting fraud, negligence and other claims against Halliburton and its former military contractor subsidiary KBR Inc. by families of civilian drivers killed in Iraq in 2004.

The high court denied the families’ petition for a writ of certiorari without commenting on the matter. The Fifth Circuit previously found that the tort-based claims were preempted by a federal workers' compensation statute that bars legal action against private military contractors.
