Law360, New York (October 12, 2012, 1:39 PM EDT) -- Jon Leibowitz, the chairman of the Federal Trade Commission, has said that the FTC is likely to conclude its investigation of Google Inc. before the end of the year. Chairman Leibowitz's immediate predecessor, William E. Kovacic, has suggested[1] that the FTC may be tempted to sue Google because government enforcers get "extra credit for big cases." He warned, however, that an action against Google under Section 5 of the FTC Act — an amorphous, ill-defined, seldom-used provision disfavored by the courts — would be risky....
