Fed. Circ. Denies Roche's Bid To Halt Boniva Generics

Law360, New York (October 11, 2012, 3:13 PM EDT) -- The Federal Circuit on Thursday refused to overturn the denial of Hoffmann-La Roche Inc.'s bid for an injunction against three rival drugmakers, preventing them releasing generic versions of osteoporosis drug Boniva, ruling a lower court had properly considered evidence from both sides.

In a 2-1 decision, the three-judge panel said U.S. District Judge Stanley R. Chesler had correctly found that Roche had failed to establish a reasonable likelihood it would succeed against the defendants' obviousness claims for the two remaining patents-in-suit — U.S. Patent Numbers 7,718,634...
