6th Circ. Spurns Ohio Restrictions On Wrong-Precinct Voting

Law360, New York (October 11, 2012, 10:35 PM EDT) -- The Sixth Circuit on Thursday blocked Ohio rules preventing wrong-precinct votes from being counted even if they were caused by poll-worker error, finding that such restrictions could potentially violate the 14th Amendment’s equal protection clause.

A three-judge panel affirmed a lower court's preliminary injunction that required wrong-precinct votes to be counted unless the state could show that it was not caused by poll-worker error and that the voter had refused to cast the vote in the correct precinct.
