Recycler Presses 1st Circ. To Reopen Solo Cup Antitrust Case

Law360, New York (October 16, 2012, 4:55 PM EDT) -- A company that recycles school lunch trays told the First Circuit on Monday that a Massachusetts federal judge had “cherry-picked” facts when he dismissed the company's claims that Solo Cup Co. and others colluded to boycott its recycling services.

In its opening appellate brief, Evergreen Partnering Group said the allegations in its lawsuit were sufficiently plausible and filled with direct accusations of conspiracy, but that U.S. District Judge Richard G. Stearns had applied an overly strict standard when he booted the case with prejudice in June....
