3rd Circ. Asked To Rethink 1st Amendment In Pa. Election Row

Law360, Philadelphia (October 19, 2012, 4:46 PM EDT) -- The Pittsburgh Post-Gazette Thursday asked the Third Circuit to overturn a state law keeping the media and anyone else not actually voting 10 feet away from polling places, claiming that Pennsylvania failed to distinguish between freedom of speech and freedom of press in its defense of the law.

In a reply brief filed with the Third Circuit, the newspaper argued that the state’s previous claim that the rule doesn't violate the First Amendment because polling places are not public forums misses the point.
