Invalidity Claims Off-Limits In Xbox Patent Suit, Motorola Says

Law360, New York (October 19, 2012, 8:15 PM EDT) -- Motorola Mobility Inc. urged the U.S. International Trade Commission to strike down Microsoft Corp.'s expert testimonies Thursday, saying arguments that patents allegedly infringed by Microsoft's Xbox system were invalid are beyond the scope of the remanded investigation.

In a motion filed Thursday, Motorola sought to exclude expert reports filed by Microsoft from a remanded Section 337 investigation, saying the reports improperly contained statements asserting that Motorola's wireless networking and digital video patents at issue — which the Xbox allegedly infringed — were invalid.
