OneWest Bank Can't Shake HAMP Loan Class Action

Law360, New York (October 23, 2012, 3:11 PM EDT) -- OneWest Bank FSB on Monday failed to escape an Illinois class action accusing it of bungling a mortgage loan modification application by unreasonably delaying its response and imposing late fees for payments that were not actually late.

Judge Sharon Johnson Coleman rejected OneWest’s argument that lead plaintiff Stacey Fletcher lacked standing, finding that her complaint alleged sufficient injury from OneWest's allegedly unreasonable delay in responding to her request for a modified loan under the Home Affordable Modification Program.
