AmerisourceBergen, Pharmacy At Draw In $106M Contract Row

Law360, New York (October 26, 2012, 6:51 PM EDT) -- A Pennsylvania federal judge on Friday denied dueling summary judgment bids by pharmaceutical wholesaler AmerisourceBergen Drug Corp. or retail pharmacy Kohll's Pharmacy and Homecare Inc. in their row over a $106 million drug supply contract, saying neither had proved its case.

According to U.S. District Judge Gene E.K. Pratter’s order denying partial summary judgment to either party, AmerisourceBergen had not proved Kohll’s early termination of the supply contract meant it owed the full $106 million supposedly due. Nor had Kohll’s proved the contract should be voided...
