Bar Association Asks Fed. Circ. To Clarify Role On Obviousness

Law360, New York (October 29, 2012, 5:59 PM EDT) -- The Federal Circuit Bar Association on Friday urged the Federal Circuit to rehear a patent infringement dispute involving Smith & Nephew Inc. and West Forrest University Health Sciences, saying the court should clarify its role in reviewing obviousness and nonobviousness determinations in patent cases tried before juries.

The bar association joined health care manufacturer Medela Inc. and four computer and information technology companies that filed three separate amicus briefs supporting Smith & Nephew's bid to have the case heard en banc.
