Justices Eye Expert Damages Testimony In Comcast Class Action

Law360, New York (November 5, 2012, 8:56 PM EST) -- Judges should only have to consider whether it's "more likely than not" that expert testimony showing damages could be calculated classwide in order to certify a class action, an attorney for plaintiffs accusing Comcast Corp. of antitrust violations told the U.S. Supreme Court on Monday.

The justices pressed both Comcast and the group of Philadelphia-area cable subscribers accusing it of monopolization to explain just how closely judges should have to weigh expert testimony on class damages before certifying a case.
