Horizon Skirts Chiropractors' ERISA Suit Over Claim Denials

Law360, New York (November 13, 2012, 10:21 PM EST) -- A federal judge on Friday dismissed a putative class action in New Jersey accusing Horizon Healthcare Services Inc. of improperly denying insurance benefit claims for chiropractic treatments, ruling that plaintiff chiropractic physicians failed to establish standing under the Employee Retirement Income Security Act.

The chiropractors claimed Horizon violated ERISA through the improper bundling of reimbursements for certain services into a global fee for another type of treatment — a practice that the health insurance company apparently corrected following regulatory action in 2009.
