DuPont, Others Can't Contest Class In Antitrust Appeal

Law360, New York (November 15, 2012, 8:14 PM EST) -- The Fourth Circuit on Wednesday denied DuPont Co. and other chemical companies permission to contest class certification for paint companies that accused them of violating antitrust law by conspiring to boost the price of a paint component.

The appellate court denied DuPont, Huntsman International LLC, Kronos Worldwide Inc. and Millennium Inorganic Chemicals Inc. permission to appeal, stifling the companies' efforts to overturn a Maryland federal court's August ruling that the paint companies had demonstrated the common injury necessary to proceed as a class.
