TCEQ Weighs Radioactive Fracking Waste Disposal Rule

Law360, Dallas (November 19, 2012, 8:13 PM EST) -- The Texas Commission on Environmental Quality on Friday floated a new rule that would allow companies to dispose of fracking fluids that contain minimal levels of radioactive material without applying for a radioactive waste license.

The agency’s executive director recommended the agency create a new rule after an Oct. 8 request from the ProTechnics division of Core Laboratories LP, which has used radioactive tracers to help predict the placement of underground oil and gas reserves since 1992.
