Patent Tossed In French Atomic Agency's LCD Case

Law360, New York (November 7, 2007, 12:00 AM EST) -- A federal judge has struck one of the Commissariat a l'Energie Atomique's patents from a long-running case over liquid crystal displays after finding that the French atomic agency failed to meet a “best mode” requirement in its patent claims.

In an order handed down on Oct. 31, Magistrate Judge Mary Pat Thynge granted Samsung Electronic Co.'s motion for summary judgment of invalidity on one of two patents in the suit, which contained a limitation requiring“a means for polarizing the incident light,” because CEA had not disclosed...
