Music Exec Fights DOJ Bid To Nix E-Books Appeal In 2nd Circ.

Law360, New York (November 28, 2012, 5:39 PM EST) -- EMusic founder Bob Kohn accused the U.S. Department of Justice on Monday of prematurely trying to dismiss his bid to fight its price-fixing settlements with three e-books publishers, telling the Second Circuit that he has standing to appeal.

Kohn argued that he clearly has standing to appeal the district court's refusal to let him intervene in the price-fixing case against Apple Inc. and five publishers. And if he overturns that order, he would then have standing to appeal the approval of the settlements the DOJ reached...
