9th Circ. Won't Rehear Alaskans' Climate Change Suit

Law360, Chicago (November 28, 2012, 7:32 PM EST) -- The Ninth Circuit refused on Tuesday to reconsider its decision not to revive an Alaskan village's public nuisance lawsuit alleging that greenhouse gas emissions from Exxon Mobil Corp. and a slew of other energy companies had made the village uninhabitable.

In a one-page order, the appellate court shot down the petition for an en banc rehearing that Kivalina, a small Inupiat Eskimo village, filed regarding the Sept. 21 ruling the plaintiff said ran contrary to U.S. Supreme Court precedent.
