10th Circ. OKs Army Corps' Permit For Kan. BNSF Facility

Law360, New York (November 28, 2012, 5:05 PM EST) -- The Tenth Circuit on Wednesday affirmed a ruling that the U.S. Army Corps of Engineers did not violate the National Environmental Policy Act when it authorized Burlington Northern Santa Fe Railway Co. to construct a Kansas rail yard on a site containing protected federal wetlands.
