Desalination Plant Challenge Axed As Tax-Free Bonds OK'd

Law360, New York (November 30, 2012, 11:31 PM EST) -- A California appeals court on Friday dismissed an environmental challenge to Poseidon Resources LLC's proposed $900 million desalination plant in Carlsbad, Calif., on the same day the developer was given the green light to issue $840 million in tax-exempt bonds to finance the project.

The appeals court affirmed a trial court's dismissal of Surfrider Foundation's suit challenging the California Regional Water Quality Control Board's pollutant discharge permit for the plant, ruling that the board complied with the water code's requirements to make sure projects minimize effects...
