Silgan Tells High Court CBA Can't Apply To Dead Worker

Law360, New York (November 30, 2012, 9:14 PM EST) -- A metal food packaging manufacturer has asked the U.S. Supreme Court to consider whether a union can force it to arbitrate a grievance related to the termination of an employee who has since died, arguing that the Eighth Circuit improperly revived the case.

Silgan Containers Manufacturing Corp. said in a certiorari petition filed Nov. 26 with the high court that the Eighth Circuit impermissibly stretched the terms of Silgan's collective bargaining agreement with Sheet Metal Workers Local No. 2 when it reversed the trial court's dismissal...
