7th Circ. Lets CBS Fight Asbestos Claims In Federal Court

Law360, Los Angeles (November 30, 2012, 9:41 PM EST) -- The Seventh Circuit on Friday reversed a lower court decision remanding to state court a Navy veteran’s asbestos exposure lawsuit against CBS Corp., ruling that the broadcasting giant may be immune from the suit as a government contractor, entitling CBS to fight the case in federal court.

A three-judge federal appellate panel unanimously ruled that CBS was entitled to federal jurisdiction due to its "colorable" argument for the government contractor defense, which immunizes government contractors when they supply products with government-approved specifications.
