Court Tosses Poland's Plea To Stave Off Carbon Cuts

Law360, New York (November 12, 2007, 12:00 AM EST) -- As furor grows among new European Union members over the bloc's carbon dioxide emission limits, the Court of First Instance has refused to suspend the European Commission's recent decision to cut the cap pending seven member states' lawsuit over it.

“The Republic of Poland has not demonstrated, as required by law, that the possibility for concerned Polish enterprises to meet the quotas on the market would be of a nature that would cause them grave or irreparable prejudice,” the court said in its ruling Friday....
