Helium Deal Not Breached In Plant Closure, Texas Court Says

Law360, Dallas (December 6, 2012, 8:45 PM EST) -- A Texas appellate court on Monday ruled Regency Gas Services LP acted in good faith when it shut down a Kansas natural gas processing plant and didn’t breach its contract with Keyes Helium Co. when it stopped delivering crude helium after the shutdown.

Keyes sued Regency after it closed the processing facility about two-and-a-half years before its contract expired to supply crude helium, a natural gas byproduct, to a Keyes plant in Oklahoma, but a jury found in an 11-1 verdict Regency wasn’t liable for failing...
