Agave Hits Sazerac With Trademark Suit Over Rum Drink

Law360, Los Angeles (December 06, 2012, 6:27 PM ET) -- Agave Loco LLC filed a trademark lawsuit against fellow liquor maker Sazerac Co. Inc. in Illinois federal court Wednesday, accusing Sazerac of infringing Agave Loco's “Rumchata” and “Chata” marks for a cream-based rum beverage.

Agave Loco, which began manufacturing cream- and cinnamon-flavored rum beverages modeled on the Spanish drink horchata in 2009, claims that New Orleans-based Sazerac started manufacturing a similar beverage to compete, giving it the allegedly infringing name 'Orchata.
