Insurer Fires Back At MLB Club's 6th Circ. Fatality Appeal

Law360, New York (December 6, 2012, 6:51 PM EST) -- CSI Insurance Group on Wednesday urged the Sixth Circuit not to revive an insurance coverage dispute over a fatal accident during a Cleveland Indians Baseball Co. LP promotion, arguing it has no duty to the Indians as a third party.

CSI argued in an appellee brief that the Indians cannot assert a negligence claim against it because Michigan law does not recognize the duty of care proposed by the ball club, which says that the insurer should be liable for underlying damages in the fatal accident...
