High Court Nixes Suit Over Murdered Wrestler's Nude Photos

Law360, New York (December 10, 2012, 7:53 PM EST) -- The U.S. Supreme Court refused Monday to consider whether the mother of deceased pro wrestling personality Nancy Benoit is owed punitive damages from Hustler magazine's publisher as penalty for allegedly violating her daughter's right of publicity by publishing her nude photos months after her murder.

The high court denied a petition for writ of certiorari filed by Maureen Toffoloni, who is both Benoit's mother and the administrator of her estate, leaving in place an Eleventh Circuit ruling earlier this year that vacated a punitive damages award...
