4th Circ. Says Hospital CEO's Forced Retirement Wasn't Bias

Law360, New York (December 11, 2012, 1:33 PM EST) -- The Fourth Circuit on Monday upheld the dismissal of a former South Carolina hospital CEO's employment discrimination suit against hospital operator Health Management Associates Inc., saying that she had failed to show that HMA forced her to retire because of her age.

A three-judge panel said HMA had a legitimate, age-neutral reason to offer Patrice Tavernier early retirement: the desire of her supervisor to marry Tavernier’s retirement plans and the hospital’s need for a change in leadership, due to Tavernier’s poor performance as CEO.
