Home Depot Can't Rush Appeal In $7B Card Fee Deal: 2nd Circ.

Law360, New York (December 11, 2012, 3:27 PM EST) -- The Second Circuit on Monday shot down Home Depot Inc.'s attempt to expedite a challenge to a $7.25 billion settlement reached to resolve class action allegations that Visa Inc. and MasterCard Inc. charged excessive fees to merchants that accept the companies' cards.

The appeals court rejected Home Depot's Nov. 29 request for an expedited briefing and argument schedule, saying it would wait to consider an appeal until after the presiding lower court has decided whether to give final approval to the settlement.
